4. Cookies

We use cookies on our website. These are small files that your browser automatically creates and stores on your device (laptop, tablet, smartphone, etc.) when you visit our site.

Cookies do not cause any harm to your device and do not contain viruses, trojans, or other malicious software. The cookie stores information that is specific to the device you are using. However, this does not mean that we immediately have knowledge of your identity. The use of cookies serves to make your use of our services more pleasant. For instance, we use so-called session cookies to recognize that you have visited certain pages of our website before. These are automatically deleted when you leave our site.

Furthermore, we also use temporary cookies to optimize user experience, which are stored on your device for a certain period. When you revisit our site to use our services, it will automatically recognize that you have been here before and which entries and settings you have made, so you do not need to enter them again. Additionally, we use cookies to statistically track the usage of our website and to evaluate and optimize our offerings for you (see section 5). These cookies allow us to recognize that you have visited us again on your next visit. These cookies are automatically deleted after a defined period. The data processed by cookies are required for the purposes mentioned in accordance with Art. 6 (1) sentence 1 lit. f GDPR, which serves our legitimate interests and those of third parties. Most browsers accept cookies automatically. However, you can configure your browser to prevent cookies from being stored on your computer or to notify you each time a new cookie is created. However, fully disabling cookies may result in you being unable to use all features of our website.

5. Analysis Tools

a) Tracking Tools

The tracking measures listed below and employed by us are based on Art. 6 (1) sentence 1 lit. f GDPR. We use these tracking measures to ensure the needs-based design and continuous optimization of our website. Additionally, we use tracking tools to statistically analyze the usage of our website and to evaluate and optimize our offering for you. These interests are deemed legitimate within the meaning of the aforementioned provision. The respective purposes of data processing and categories of data are specified in the respective tracking tools.

i) Google Analytics

For the purpose of ensuring the needs-based design and continuous optimization of our site, we use Google Analytics, a web analytics service from Google Inc. (https://www.google.de/intl/en/about/) (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter referred to as "Google"). In this context, pseudonymized usage profiles are created, and cookies (see section 4) are used. The information generated by the cookie about your usage of this website, such as:

  • Browser type/version,

  • Operating system used,

  • Referrer URL (the previously visited page),

  • Hostname of the accessing computer (IP address),

  • Time of the server request,

is transferred to a Google server in the USA and stored there. The information is used to evaluate the website's usage, to compile reports on website activities, and to provide further services related to website usage and internet usage for market research and needs-based website design. These information may also be transmitted to third parties if required by law or if third parties process these data on our behalf. Under no circumstances will your IP address be merged with other Google data. The IP addresses are anonymized, so that identification is not possible (IP masking). You can prevent the installation of cookies by adjusting your browser settings; however, we point out that in this case, some features of this website may not be fully usable.

You can further prevent the collection of data generated by the cookie and related to your use of the website (including your IP address) and the processing of these data by Google by downloading and installing a browser add-on (https://tools.google.com/dlpage/gaoptout?hl=en).

Alternatively, especially for browsers on mobile devices, you can prevent Google Analytics' collection by clicking on https://tools.google.com/dlpage/gaoptout. This will set an opt-out cookie, preventing future data collection during your visits to this website. The opt-out cookie applies only to this browser and only to our website and will be stored on your device. If you delete the cookies in this browser, you will need to set the opt-out cookie again. More information on Google Analytics data protection can be found in the Google Analytics Help.

ii) Google Adwords Conversion Tracking

To statistically track the usage of our website and to optimize the website for you, we also use Google Conversion Tracking.

In this context, Google Adwords sets a cookie (see section 4) on your computer if you have arrived at our website via a Google ad. These cookies expire after 30 days and are not used for personal identification. If the user visits specific pages of the Adwords customer's website and the cookie has not expired, Google can request data protection authorities to conclude a data processing agreement for the lawful use of Google Analytics. A corresponding template is available from Google at this link. Each Adwords customer receives a different cookie. Cookies cannot be tracked across the websites of Adwords customers. The information collected by the conversion cookie is used to generate conversion statistics for Adwords customers who have opted for conversion tracking. Adwords customers learn the total number of users who clicked on their ad and were directed to a page with a conversion tracking tag. However, they do not receive any information that would allow the identification of individual users.

If you do not want to participate in the tracking process, you can reject the necessary setting of a cookie, for example, by adjusting your browser settings to prevent cookies from being set in general. You can also disable cookies for conversion tracking by setting your browser to block cookies from the domain "www.googleadservices.com". Google's privacy policy for conversion tracking can be found here.

iii) Matomo

We use the open-source software Matomo to analyze and statistically evaluate the use of our website. Cookies (see section 4) are used for this purpose. The information generated by the cookie about website usage is transmitted to our servers and compiled into pseudonymized usage profiles. The information is used to evaluate website usage and to enable a needs-based design of our website. Information is not shared with third parties. Under no circumstances will the IP address be linked with other user-related data. IP addresses are anonymized so that identification is not possible (IP masking). Your visit to this website is currently being recorded by the Matomo web analytics tool. Click here to prevent your visit from being tracked.

6. Social Media Plugins

We use social media plugins from Facebook, Twitter, and Instagram on our website based on Art. 6 (1) sentence 1 lit. f GDPR to make our law firm more widely known. The advertising purpose behind this is considered a legitimate interest within the meaning of the GDPR. The responsibility for ensuring data protection compliance lies with the respective providers. The integration of these plugins is carried out using the so-called two-click method to best protect the visitors of our website.

a) Facebook

Our website uses social media plugins from Facebook to make its use more personal. For this, we use the "LIKE" or "SHARE" button. This is an offer from Facebook. When you visit a page on our website that includes such a plugin, your browser establishes a direct connection with Facebook's servers. The content of the plugin is transmitted directly from Facebook to your browser and integrated into the webpage.

By embedding the plugins, Facebook is informed that your browser has visited the corresponding page of our website, even if you do not have a Facebook account or are not logged into Facebook at the time. This information (including your IP address) is transmitted directly from your browser to a server of Facebook in the USA and stored there. If you are logged into Facebook, Facebook can directly associate the visit to our website with your Facebook account. If you interact with the plugins, for example, by clicking the "LIKE" or "SHARE" button, the corresponding information will also be transmitted directly to a Facebook server and stored there. The information will also be published on Facebook and shown to your Facebook friends. Facebook may use this information for advertising, market research, and the needs-based design of Facebook pages. For this purpose, Facebook creates usage, interest, and relationship profiles, e.g., to evaluate your usage of our website in relation to the ads displayed to you on Facebook, inform other Facebook users about your activities on our website, and provide additional services related to Facebook usage. If you do not want Facebook to associate the data collected on our website with your Facebook account, you must log out of Facebook before visiting our website. The purpose and scope of data collection, further processing, and use by Facebook, as well as your rights and privacy settings, can be found in Facebook's privacy policy.

b) Twitter

On our website, we have integrated plugins from the microblogging network Twitter Inc. (Twitter). The Twitter plugins (tweet buttons) can be identified by the Twitter logo on our page. You can find an overview of tweet buttons here (https://about.twitter.com/resources/buttons).

When you visit a page of our website that contains such a plugin, a direct connection is established between your browser and the Twitter server. Twitter then receives the information that your IP address has visited our site. If you click the Twitter "tweet button" while logged into your Twitter account, you can link the content of our pages to your Twitter profile. This allows Twitter to assign the visit to our site to your user account. We would like to point out that, as the provider of the pages, we have no knowledge of the content of the transmitted data or how it is used by Twitter.

If you do not want Twitter to associate the visit to our pages with your Twitter account, please log out of your Twitter user account. For more information, please refer to Twitter’s privacy policy (https://twitter.com/privacy).

7. Rights of the Data Subject

You have the right to:

  • Under Article 15 of the GDPR, request information about the personal data we process. Specifically, you may request information about the purposes of processing, the categories of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage duration, the existence of a right to correction, deletion, restriction of processing, or objection, the existence of a right to lodge a complaint, the origin of your data, if it was not collected by us, as well as information about automated decision-making, including profiling, and if applicable, meaningful information about their details;

  • Under Article 16 of the GDPR, request the immediate correction of inaccurate or the completion of incomplete personal data stored by us;

  • Under Article 17 of the GDPR, request the deletion of your personal data stored by us, unless the processing is necessary to exercise the right to freedom of expression and information, to fulfill a legal obligation, for reasons of public interest, or to assert, exercise, or defend legal claims;

  • Under Article 18 of the GDPR, request the restriction of processing of your personal data, if the accuracy of the data is contested, the processing is unlawful, but you oppose its deletion, and we no longer need the data, but you require it for the assertion, exercise, or defense of legal claims, or you have objected to the processing according to Article 21 of the GDPR;

  • Under Article 20 of the GDPR, receive your personal data, which you have provided to us, in a structured, commonly used, and machine-readable format or request the transfer to another controller;

  • Under Article 7, Section 3 of the GDPR, withdraw your consent given to us at any time. This means that we may no longer continue the data processing that was based on this consent in the future; and

  • Under Article 77 of the GDPR, lodge a complaint with a supervisory authority. In most cases, you can contact the supervisory authority of your usual place of residence, your place of work, or the location of our office.

8. Right to Object

If your personal data is processed based on legitimate interests under Article 6, Section 1, Sentence 1, lit. f of the GDPR, you have the right to object to the processing of your personal data under Article 21 of the GDPR, if there are reasons related to your particular situation, or if the objection is made against direct marketing. In the latter case, you have a general right to object, which will be implemented by us without the need for a specific situation.

If you wish to exercise your right of withdrawal or objection, an email to mamozai@mm-legale.de will suffice.

9. Data Security

We use the commonly used SSL (Secure Socket Layer) procedure during your visit to the website, in connection with the highest encryption level supported by your browser. Typically, this is 256-bit encryption. If your browser does not support 256-bit encryption, we instead use 128-bit v3 technology. You can recognize whether a page on our website is transmitted encrypted by the closed padlock or key symbol in your browser's status bar.

Additionally, we use appropriate technical and organizational security measures to protect your data from accidental or intentional manipulation, partial or complete loss, destruction, or unauthorized access by third parties. Our security measures are continuously improved in line with technological developments.

Due to the further development of our website and offers or changes in legal or regulatory requirements, it may become necessary to amend this privacy policy. The latest version of the privacy policy can be accessed and printed at any time on the website at https://www.mm-legale.de.
